The City of Sydney has refused two applications from one of the biggest pubs in Kings Cross, setting the scene for a test case on councils’ rights to reject development applications from hotels if an area has too many already.
The council has rejected the Empire Hotel’s applications for a rooftop bar and a licensed cafe, which would increase its capacity by about 15 per cent. The motion for refusal said “Darlinghurst Road … has reached a saturation of licensed premises” and “approval of the application would have negative social and environmental impacts”.
